"User", "Client", "user", "you", "your" or other similar terminology are all in reference to you, as the user of the website, and as a recipient of our Services and resources for the remainder of this document.

"Platform" or similar terminology are all in reference to the website or web links that the User can employ to access Services provided by the Firm.

Fettle Counselling is a mental health initiative aiming at providing psychotherapy and other such services to individuals and organizations. These include, but are not limited to individual psychotherapy, group psychotherapy, corporate training programs, and collaborations with NGOs.

Fettle Counselling offerings may include:

• Online or face-to-face psychotherapy consultations with practitioners on the platform who have been authorized to use our platform to deliver their services.

• Workshops, webinars, and live discussions conducted by our trained MHPs.

• Self-help tools, content, and programs that are provided via our website, emails, and Instagram.

• Participation in user forums, topics, replies, comments, feedback, blogs, and any other submissions on the platform;

Fettle Counselling reserves the right to add or remove products and Services from its overall offerings without prior notification. The aforementioned shall hereinafter be referred to as "Services".

 

Usage and Access of the Website

We hereby grant you a limited license to view and use the website only as an aid to properly engaging with the Website as a User. You may use the Website only in a manner consistent with your bona fide needs.

We reserve the right to charge a fee for our Services. The User agrees to pay all applicable fees/charges upfront to Fettle Counselling and also authorizes us to automatically deduct all applicable charges/fees from the payments made as and when such features are accessed on our platform. Further, the user agrees to be responsible for any telephone charges and/ or internet service fees that may be incurred in accessing Fettle Counselling.

Fettle Counselling reserves the right to change any or all parts of the Payment policy without notice or liability to the user or any third party.

Fettle Counselling does not guarantee that you will be accepted as a registered user or as a client by the practitioners on our Website. Fettle Counselling reserves the right to terminate your registration with our platform at any time without citing a reason. Fettle Counselling is a Service in terms of connecting psychotherapists to users. However, Fettle Counselling does not commit or guarantee any psychotherapy-related outcomes. Neither is Fettle Counselling responsible for the availability of the practitioner. Once the practitioner is assigned to the user, the practitioner becomes the direct point of contact for all further details. In certain situations, practitioners may deem online therapy to be unfit for your needs, in this case they may choose to refer discontinue services.

Every practitioner on our team has their credentials thoroughly checked. However, Fettle Counselling disclaims all liability for any false information provided or claims made by these practitioners. A profile page is dedicated to each professional on our team. However, it becomes the duty of the practitioner to verify and provide accurate information about themselves.

Our practitioners have a contractual agreement with Fettle Counselling and are allowed to use the Website and Services. Fettle Counselling disclaims all liability for their decisions, recommendations, and any information made available through our Website or in any other way. Fettle Counselling disclaims all responsibility for any harm, direct or indirect, that a practitioner may inflict on the user. The user acknowledges that they alone are in control of their choices and activities, free from any influence from Fettle Counselling or the practitioners. 

No specifications in terms of medication are provided by the team at Fettle Counselling. Often, if medication is required, referrals for medical professionals may be given. However, Fettle Counselling does not take the responsibility of verifying the accuracy of the services provided by that medical professional. It is the responsibility of the user to find out more details before committing to any medical/psychiatric treatment.

All information provided by Fettle Counselling or by any third-party is solely for informational purposes and should not be relied upon or used as the sole basis for making decisions without consulting other accurate information. Fettle Counselling is not liable if the information made accessible on the Website or other platforms is not accurate, or updated. Fettle Counselling reserves the right to change and update information or content at any time, but we have no obligation to update any information on our platform. Following an ethical code of conduct, at Fettle Counselling, we believe it is unethical for our practitioners to have dual relationships with current or former clients. During and after our counselling work, you are forbidden to have any individual relationship of any other type with our practitioners; this includes association on social and professional network websites such as Facebook, Instagram, Linkedin, Twitter, etc. This will ensure that our professional relationship remains clear should you ever want to resume counselling or refer others to us.

You hereby indemnify, defend, and hold the Firm, the Firm's distributors, agents, representatives, and other authorized users, and each of the foregoing entities' respective resellers, distributors, Service providers and suppliers, and all of the foregoing entities' respective officers, directors, owners, employees, agents, and representatives, harmless from and against any/all losses, damages, liabilities and costs arising from your use of the Website or our Services.

 

Disclaimer on Warranties

Fettle Counselling and related Services are provided without any warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Indemnity

You hereby agree to indemnify Fettle Counselling and agree to defend the Firm, its partners, affiliates, service providers, employees, and interns and hold harmless against losses, damages, costs, and liabilities (including legal fees, made by any third-party due to or arising out of your breach of these Terms. You agree to indemnify Fettle Counselling for any breach of these Terms. Dispute Resolution and Grievance Redressal

Fettle Counselling will be entitled to nominate a sole arbitrator in the case of any kind of disputes or claims arising out of our Service. The venue of arbitration shall be in Mumbai, Maharashtra. Courts in Mumbai shall have exclusive jurisdiction for all claims arising from this consignment. No other venue for arbitration shall be accepted. The user agrees to these Terms. 

To address the grievances of the users, Fettle Counselling has set up a Grievance Redressal Forum. We assure you a time-bound response not exceeding one month from the date of your complaint.

 

Jurisdiction

Jurisdictional policies of Fettle Counselling have been created according to and in compliance with Indian laws. Any/all disputes arising between the user and Fettle Counselling regarding this Policy, including the interpretation of these terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
